Please read these Terms of Service ("Terms") carefully before purchasing or using any services offered by A SAD COMPANY LLC ("Company," "we," "us," or "our") through CustomGivingHub at customgivinghub.com ("Site"). By completing a purchase or using our services, you agree to be bound by these Terms.
CustomGivingHub provides website design, development, and deployment services for nonprofit organizations using the Givebutter fundraising platform ("Services"). Our Services include building a custom website connected to your Givebutter account, deploying it to a Vercel hosting account, configuring your custom domain, and transferring project ownership to you upon completion and approval.
We are an independent service provider and are not affiliated with, endorsed by, or in any way sponsored by Givebutter, Inc. or Vercel, Inc.
All fees are due in full at the time of purchase. Our current service fee is $2,000 USD (one-time). Fees are non-refundable except as described in Section 4 below.
In addition to our one-time service fee, ongoing hosting of your website requires a Vercel Pro account, currently priced at $20/month, billed directly to you by Vercel. This is a third-party cost and is not included in our service fee.
Following receipt of your completed intake form with all required assets, we will deliver a working website for your review within a reasonable timeframe. We will notify you when the site is ready for approval. You will have the opportunity to request reasonable revisions before final delivery.
Timelines may be affected by delays in receiving your assets or approvals. We are not responsible for delays caused by third-party services including Givebutter, Vercel, or your domain registrar.
Because our Services involve significant labor and customization, all sales are generally final. However:

Upon final payment and your approval of the delivered website, we will transfer full ownership of the Vercel project to you. At that point, all code, assets, and configurations delivered as part of your project become your property.
We retain the right to use general knowledge, skills, and techniques acquired during the performance of Services in future projects. We may reference your project as part of our portfolio unless you request otherwise in writing.
You represent that all assets you provide to us (logos, images, copy, etc.) are owned by you or that you have the right to use them. You agree to indemnify us against any claims arising from your assets.
Our Services depend on third-party platforms including Givebutter and Vercel. We are not responsible for outages, changes, or discontinuation of those services. Your continued use of those platforms is subject to their respective terms of service.
We are not responsible for any changes Givebutter or Vercel makes to their APIs, pricing, or features after your project is delivered.
Our Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that results will meet your specific requirements.
To the maximum extent permitted by applicable law, A SAD COMPANY LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or loss of donations, arising out of or related to these Terms or our Services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms shall not exceed the total amount you paid us for the Services giving rise to the claim.
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Fort Bend County, Texas.
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our Services after changes are posted constitutes your acceptance of the updated Terms.
